Many people contact our office asking whether they should file an application for Social Security benefits or Supplemental Security Income. Typically, they wonder if they will qualify for benefits. But they also wonder if they should wait to file for benefits.  After all, many people are injured and think they will recover and return to work. Or, they become ill, but believe they will soon get better.

Whether you have suffered a serious job injury or have a chronic disease, every day you wait to file for SSD benefits is a day that you lose money.

SSD benefits are available one year prior to the date of application, as long as you were not working during that past year. SSI benefits are available on the date of application, but not prior to the date of the application.

If you stop working and fail to apply, then your “insurance” with the SSA program runs out. If your insurance runs out, then you have a “date last insured” problem. This means, you must prove you were disabled in the past, when you last had insurance with the program.
